Cabinet Revision of the classification/upgradation certain cities/towns on the basis of Census-2011 for the purpose of grant of House Rent Allowance and Transport Allowance to Central Government employees

The Union Cabinet, chaired by the Prime Minister Shri Narendra Modi, has given its approval to the proposal of the Ministry of Finance, Department of Expenditure for reclassification/upgradation of certain cities/towns on the basis of Census-2011, for the purpose of grant of House Rent Allowance (HRA) and Transport Allowance to Central Government employees.On the basis of the final population figures of Census-2011, two cities have qualified for being upgraded from 'Y' class to 'X' class and 21 cities have qualified for being upgraded from 'Z' to 'Y' class for the purpose of HRA. Six cities have qualified for being upgraded from "Other Places" to specified higher class for the purpose of Transport Allowance.The revised classification of cities shall take effect from 01.04.2014. The impact on the exchequer on account of upgradation of 29 cities, would be approx. Rs.128 crore for the year 2014-15.Background:HRA and Transport Allowance are admissible to Central Government employees depending upon employees' Basic Pay (including NPA where applicable)/Grade Pay and the classification of the city/town where they are posted. The existing classification of cities/towns in different classes viz. 'X', 'Y' and 'Z' for the purpose of HRA and 13 specified cities classified earlier as 'A-1'/ 'A' and "Other Places" for the purpose of Transport Allowance, is as per the criterion recommended by the 6th Central Pay Commission. The existing qualifying limits of population for classification for HRA purpose is 50 lakhs & above for 'X', 5 - 50 lakhs for 'Y' and below 5 lakhs for 'Z' class city. Transport allowance is payable at 'higher rates' in 13 specified cities classified earlier as 'A-1' / 'A' (that is those cities having population of 20 lakhs & above) and at 'lower rates' in all other places.The classification of cities/towns for this purpose is revised on the basis of their population as reflected in the decennial census report. The existing classification of various cities/towns is based on 2001 Census figures. The criterion of population for this purpose has been followed as recommended by the Central Pay Commissions.

GSTN ....

Work has started on creating a network for GST, even before it is clear as to whether it is going to be like and what the network is supposed to provide. Our earlier experience with ACES was that it was created with the  assessee (only) in mind and as a result, the much talked about generation of reports could not be done with it and work load never actually decreased, but only pressure increased due to the non working of the system during peak hours. Now at least, the Cadre organizations have to bring it to the notice FM that unless the departments concerned are involved in decision making and designing, employing professionals alone would not yield results. Not only at Delhi, pilot projects with Officers of the departments concerned have to be created at all parts of the Country, if such a massive exercise should not go waste.

Heart felt condolences

suicide owing to the work pressure  While we are deeply 

concerned with what his family suffered due to such severe 

step of him. I, in the capacity of an Inspector and an 

Association office bearer, appeal all the cadre members that 

no problem can be as important as your family and friends. 

All new officers should feel free to contact their senior 

colleagues and Association in the moments of distress.

Ganesh Narayan Meena, ( Inspector, Service Tax , 

Banglore) passing. Heart felt condolences to his family.

Final Seniority List of Inspectors as on 01.01.2014.

It is to intimate that the Additional Commissioner (CCO), Vadodara has vide letter dated 11.05.2015 issued from F. No. II/34-08/CCO/2013 circulated the Final Seniority List as on 01.01.2014 in the Grade of Inspectors working under Cadre Controlling Authority, Vadodara. The Final Seniority List as on 01.01.2014 has been issued with the approval of the Chief Commissioner, Central Excise: Vadodara Zone, Vadodara and the same is available  on the website of CCO, Vadodara i.e. www.ccovadodarazone.gov.in. It is requested to go through the same and clerical errors like Spelling of Name, DOB, Category etc. may be brought to the notice of the competent authority for necessary corrections at the earliest.

INCOME TAX EXEMPTION / DEDUCTION ON INTEREST PAID ON EDUCATION LOAN

            Section 80E of the Income-tax Act, 1961 provides that in computing the total income of an individual, their shall be allowed a deduction of the amount paid by way of interest on loan taken by him from any financial institution or approved charitable institution for the purpose of pursuing his own higher education or higher education of his spouse, or children, or the student for whom he is the legal guardian. The deduction is available for eight assessment years beginning with the assessment year in which the payment of interest on such loan is first made or until the interest is paid in full, whichever is earlier. This deduction is available to every individual who is liable to income-tax. No specific funds are earmarked for the purposes of extending tax concession against interest paid on education loan.
            This was stated by Shri Arun Jaitley, Union Finance Minister in written reply to a question in the Rajya Sabha today.
EXTRACT OF SECTION 80E OF INCOME TAX ACT 1961
            Under Section 80E of the Act a deduction will be allowed in respect of repayment of interest on loan taken for higher education, subject to the following conditions:

(i)In computing the total income of an assessee, being an individual, there shall be deducted, in accordance with and subject to the provisions of this section, any amount paid by him in the previous year, out of his income chargeable to tax, by way of interest on loan, taken by him from any financial institution or any approved charitable institution for the purpose of pursuing his higher education or for the purpose of higher education of his spouse or children.

(ii)        The deduction specified above shall be allowed in computing the total income in respect of the initial assessment year and seven assessment years immediately succeeding the initial assessment year or until the interest referred to above is paid in full by the assessee , whichever is earlier. For this purpose –

            (a) “approved charitable institution” means an institution established for charitable purposes and approved by the prescribed authority under clause (2C) of section 10, or, an institution referred to in clause (a) of sub-section (2) of Section 80G. Section 80E 35

            (b) “financial institution” means a banking company to which the Banking Regulation Act, 1949 (10 of 1949) applies (including any bank or banking institution referred to in section 51 of that Act); or any other financial institution which the Central Government may, by notification in the Official Gazette, specify in this behalf;

            (c) “higher education” means any course of study pursued after passing the Senior Secondary Examination or its equivalent from any school, board or university recognised by the Central Government or State Government or local authority or by any other authority authorised by the Central Government or State Government or local authority to do so;

            (d) “initial assessment year” means the assessment year relevant to the previous year, in which the assessee starts paying the interest on the loan.

            (e) relative”, in relation to an individual, means the spouse and children of that individual or the student for whom the individual is the legal guardian

POST RETIREMENT BENEFITS

 

     Department of Personnel & Training has not made any change in instructions contained in OM No. 22011/4/1998-Estt.(D) dated 12.10.1998 and reiterated vide OM No. 22011/1/2014-Estt.(D) dated 14.11.2014. These instructions provide for consideration of retired employees, who are within the zone of consideration in the relevant year(s) while preparing year-wise panel(s) for promotion. Such retired officials, however, have no right for promotion as they are not available to assume charge of the higher post. 

            This was stated by the Minister of State for Personnel, Public Grievances and Pensions and Minister of State in the Prime Minister’s Office Dr. Jitendra Singh in a written reply to a question by Dr. Udit Raj in the Lok Sabha today.

Sub:­ Inter-Commissionerate Transfers- Request for issue of instructions –reg.

Madam,

              This Association would like to draw your kind attention to the Board’s circular F.No.A-22015/23/2011-Ad.III.A dated 27.10.2011, containing the guidelines for Inter-commissionerate transfer of Group ‘B’, ‘C’ & ‘D’ officers under CBEC.
2.      This is to bring to your kind notice that the Cadre Controlling Authorities under various zones are following divergent policies owing to which the deserving candidates, whose request was considered as genuine, are unable to get the requisite benefit of transfer.
3.        Kindly find enclosed a copy of the order dated 18.03.2015 passed by the Hon’ble Central Administrative Tribunal, Ernakulum on a batch of applications filed by the officers who were granted Inter-commissionerate transfer but have not been relieved. The cadre controlling Chief Commissioner, Cochin had granted concurrence in respect of those officers for their transfer to various zones and the respective cadre controlling chief commissioners have issued necessary orders of transfer. However, the CCA, Cochin has delayed the relief on administrative grounds (citing shortage of staff), due to which these officers had approached the Hon’ble Tribunal for relief. The Tribunal has ordered that these officers shall be relieved within a period of 40 days from the date receipt of the order. However, it has come to our notice that the CCA has challenged the said order in the Hon’ble High Court of Kerala and obtained a stay order for a period of 4 months. The relief of these officers has therefore been further delayed. 
4.      Madam, you would appreciate that these officers had sought transfers to their respective hometowns/other places of their need, on compassionate grounds, which were considered to be genuine based on which the orders for transfers have been issued. However, if their relief is delayed, the very purpose of which transfer was sought and considered is defeated.  Many zones cancelled the ICT orders due to non-relieving of officers from particular zone.  If an order of ICT is cancelled for no fault of the officers then it may well be impossible for them to get another opportunity for transfer in the near future. The reason cited by the Cadre controlling authorities for delaying the relief on administrative grounds is unjustified, as the vacancy position across all zones is higher. Subsequent to the above, the requests of officers for transfer on genuine medical grounds are not being considered and kept pending.

5.     One of the conditions of ICT is that the officers who are seeking transfers would be placed at the bottom of the seniority list and delay in relief will result in loss of their seniority as officers from other zones are likely to report ahead of them and also in case of new recruits joining the respective zones. Madam, it is now learnt that the SSC has declared the results of the CGL Examination for the year 2013 and new recruits are likely to join the department in the coming days. In case of any delay in relief and cancellation of the orders already issued, these officers will stand to lose enormously and the purpose for which they sought transfer will forever remain unfulfilled. The provisions for inter-commissionerate transfer were meant to alleviate the sufferings of the officers who are posted far away from their hometowns. However, the decisions/divergent views taken by various cadre controlling authorities are scuttling the purpose for which it was brought in.
6.     Many CCAs are not forwarding the applications of ICT to other zones, even on extreme compassionate grounds (i.e. disease like cancer to his/her dependent), which is causing great mental agony, sufferings and economic crisis to the family of Inspectors.  Administration takes different measures for consideration of ICT or granting NOC for ICT.  They, sometimes, act differently under same zone.  For example, a Commissionerate forwards application for ICT whereas other Commissionerate rejects the application in the same Cadre Controlling Zone citing different reasons.  Central Excise Zone, Kolkata is also not relieving Inspectors even the Inspectors have been granted ICT to other zone citing administrative exigencies.  This arbitrary action of the administration is marring the purpose of the Board’s guidelines on ICT.
7.     There are neither proper guidelines for forwarding the application of ICT by a CCA nor any proper guidelines for consideration of the same by other CCA.  There are also no proper guidelines for ICT on Spouse Grounds in this existing circular.
8.     Under these circumstances, it is requested that appropriate instructions may kindly be issued for maintaining uniformity in respect of Inter-Commissionerate transfers. Awaiting issuance of favourable orders, we remain.

Sub: Non-observance of CBEC Guidelines regarding Hon’ble Supreme Court Judgment in the Case of N R Parmar v/s. Union of India by many CCAs - Reg.

Madam,

    Please refer to the letter No. A-32022/06/2014-Ad.III A dated 08.09.2014 issued by the CBEC, New Delhi regarding Inter-Se Seniority of Direct Recruit & Promotee Officers.

   In this context, it is to submit that many Cadre Controlling Authorities have not yet finalized the Seniority List of Inspectors in light of Hon’ble Supreme Court judgment in the case of N R Parmar v/s. Union of India.  The CCAs of Central Excise & Service Tax Zones like Bangalore, Mumbai, Ranchi etc. have not prepared the Seniority List yet, despite the lapse of many months.

       Many Inspectors of different zones have forced to move to CAT in order to get the said judgment implemented. For example, some officers in the grade of Inspectors had to approach the Hon’ble Central Administrative Tribunal, Ahmedabad, which granted a blanket stay on conduct of DPC, till Seniority List dated 01.01.2013 is revised in light of the said judgment of Hon'ble Supreme Court.  Finally, the draft Seniority List as on 01.04.2014 was prepared by CCA, Vadodara as per the guidelines of CBEC regarding the implementation of the Hon’ble Supreme Court judgment in the case of N R Parmar v/s. Union of India and was submitted to the Hon’ble Central Administrative Tribunal, Ahmedabad on 07.10.2014.  Further, CCA, Vadodara vide its letter dated 14.10.2014 (copy enclosed) published the revised draft Seniority List as on 01.04.2014. However, the same could not be finalized as some of the Inspectors of 2003 Batch (Joined in the year 2005) subsequently approached the Hon’ble High Court of Gujarat for implementation of the said Hon’ble Supreme Court judgment in their case as well and the same is pending before the Hon’ble High Court, but it is pertinent to mention that no stay has been granted by the Hon’ble High Court on the Seniority List as on 01.04.2014 till date.
        
     Madam, despite Association's requests dated 28.04.2015 & 29.04.2015, the Chief Commissioner of Central Excise, Vadodara/Ahmedabad zone is validating the “Seniority List as on 01.01.2013” for the purpose of calling willingness of Officers in the grade of Inspectors for Gujarat Customs in view of AGT-2015 instead of the “Seniority List of 2014”.

         Madam, this situation persists in many zones (like Kolkata) where the seniority list on the basis of the above said judgment of Hon'ble Supreme Court has been prepared and circulated but for promotion, AGT & other matters, the old seniority list is being used.

     In this regard, it is requested to issue suitable directions to the competent authorities for preparation & issuance of Seniority List in light of N R Parmar Judgment without further delay and issuance of ‘Due List’ of Inspectors for Gujarat Customs in consonance with the Draft Seniority List as on 01.04.2014.
