Notice for Central Executive Committee (CEC) Meeting at Ahmedabad
on 25th & 26th of September, 2015

            Notice is hereby issued for the meeting of the Central Executive Committee of All India Central Excise Inspectors' Association to be held on 25th & 26th of September, 2015 at Ahmedabad.

            The Meeting shall commence at 10:00 AM sharp on 25.09.2015 and conclude by 05:00 PM on 26.09.2015.

Agenda
1.      Presidential Address
2.      Reading and Confirmation of the minutes of CEC Meeting held at Kolkata on 13th & 14th February 2015.
3.      Tabling of Action Taken Report (ATR) by the Secretary General.
4.      Discussion on ATR.
5.      Fixing of Date and Venue of the next Meeting of the CEC of AICEIA.
6.      Any other items with the permission of the Chair


            The Venue of the Central Executive Committee Meeting shall be informed very soon, once it is confirmed by the Ahmedabad Branch of AICEIA.


Note:-
1.      Each Branch/Circle is hereby requested to submit details of their accounts, which may kindly be sent to the Secretary General/President by e-mail by 31.08.2015 in order to enable incorporation of the same in the Action Taken Report to be presented by the Secretary General.

2.      Confirmation of attendance and details of arrival and departure of All India Office Bearers and all CEC Members (Name, Mobile No., Post held in Circle/Branch/Unit) who shall be attending the said meeting may please be made by the concerned Branch/Circle Secretary to the following Members latest by 31.08.2015:-

4.  All Office Bearers of the Central Committee of AICEIA are required to send by 31.08.2015 at above e-mail ids a comprehensive account of all major initiatives, meetings and tours undertaken by them including drives to enhance membership and strengthen organization at the grassroots level, and all significant engagements with the Departmental Authorities, Sister Organizations, Confederation etc. during 15.02.2015 to 31.07.2015.

5.  Any Circle/Branch/Unit desirous of sponsoring any resolution in the meeting may send a draft of the same with brief explanatory notes to the President and Secretary General latest by 31.08.2015.

The Hon’able Apex Court on their decisions dated 18.12.14 in the case of State of Punjab vrs. Rafiq Masih ( Civil Appeal No. 11527 of 2014) have decided that in the following cases wherein recoveries from the employees , would be impermissible in law:

·       1.      Recovery from employees belonging to Class-III & Class-IV service ( or Group-C and Gr-D service)
·       2.      Recovery from retired employees or employees who are due to retire within one year of the order of recovery.
·       3.      Recovery from employees, when excess payment has been made for a period in excess of five years, before the order is issued.
·       4.      Recovery in cases where an employee has wrongfully been required to discharge duties of a higher post and has been paid accordingly, even though he should have rightfully been required to work against an inferior post.

  • 5.      In any other case, where the Court arrives at the conclusion, that recovery if made from the employees, would be iniquitous or harsh or arbitrary to such an extent as would far outweigh the equitable balance of the employer’s right to recover.

        Kind attention is invited towards our previous letters.
2.                In continuation kind attention is drawn towards certain more issues as suggested by officers and brought to the notice of the association.

  • To extend the Cashless Facility for Medical treatment at M/s Apollo Hospital International Ltd, Ahmedabad:- In this regard it is humbly submitted that many officers are facing hardship because of non availability of Cashless Facility for Medical treatment. The Cashless Facility for Medical treatment available at M/s Shalby Hospital is going to expire by midnight of 31.10.2015. Sometimes of many officers have to undergo Critical Illness Treatment, which is very expensive, and many times officers are not able to bear the Medical expenses attached to Critical Illness Treatment/Care. In the recent past instances have occurred which has exposed the Department inability to help the officers at hour of utmost need of Medical Protection.  Accordingly, it is requested that Cashless Facility for Medical treatment at M/s Apollo Hospital International Ltd, Ahmedabad may be started in the line of Income Tax. Income Tax Department, has signed Memorandum of Agreement with M/s Apollo Hospital International Ltd, Ahmedabad (Copy enclosed for reference pl.)


·        Non Updating of Tax Credit Statement (Form 26AS)  for Income Tax purpose:- It is humbly submitted that an instruction may be issued to all the Commissionerate to update the Form 26AS, as the feedback has been received that Form 26AS, is not updated for many officers across the cadre, and as the last date of filling the Income Tax Return is approaching fast, it would be helpful for every officers , if the Form 26AS, is updated.
            It is also requested Association may also kindly be given an opportunity to present our case in                        person.
